endota Retreat terms & conditions

By registering as a member of endota Retreat® or by redeeming any endota Retreat® Member Benefits, you agree to be bound by, and your participation in the endota Retreat® Platform will be governed by, these terms and conditions.

In these terms and conditions, references to: "we", "our" and "us" are references to endota and references to "you" and "your" are references to the individual who has registered as an endota Retreat® member, or who has sought to access or use any Member Benefits.


1. What is endota Retreat*?

1.1. The endota Retreat® Platform is operated and administered by endota (No. 1) Pty Ltd (A.C.N. 107 095 983) ("endota").

1.2. The endota Retreat® Platform is an on demand 24/7 video platform providing access to digital content to support your journey to a better wellbeing.

2. How to become an endota Retreat® member - Your agreement and subscriptions

2.1. There are 2 ways to join the endota Retreat® Platform to gain access to varying levels of Member Benefits:

2.1.1 You can create and sign into an endotaOne account. Click here to begin; or

2.1.2 You can subscribe to one of our membership packages. Click here to begin.

2.2. There are various access levels:

2.2.1. As a guest: No joining fee access: ‘Guest Access’ will have access to limited video and recipe content and no cancellation periods;

2.2.2. As a paid complete endota Retreat® member that has access to all endota Retreat® content and also the membership package of products and treatments and enters into the contract periods;
Along with full access to content also receive: 1 x endota skincare seasonal product – dispatched within the first 2 weeks of each new season (in the southern hemisphere March–Autumn, June-Winter, Spring–September and Summer–December) and 4x $35 endota Freedom Gift Cards – first sent within 7 days and second, third and fourth within 6-12 months of membership. Members receive a maximum of 2 x $35 endota Freedom Gift Cards within a 6 month period. If members are not within a geographical area of a spa, then complete members can redeem online with endota products.

2.2.3. Complete endota Retreat® membership terms:

2.2.3.1. 12 months – paid monthly or upfront with a minimum cancellation term of 3 months. At the conclusion of the 12 months, then members will be rolled over into a monthly membership, unless they direct otherwise. They also have the opportunity to sign up to a 12-month membership.

2.3. endota Retreat® membership is only available for individuals.

2.4. We reserve the right to refuse your application for membership or cancel your membership at any time for any reason.

2.5. Membership is non-transferable.

2.6. It is your responsibility to keep your personal details updated. To update your details, you must complete an updated registration form here. If you do not keep your personal details up to date, we may not be able to offer or provide you with any endota Retreat® Member Benefits, and we may need to cancel your membership.

3. Website

3.1. These Terms and Conditions govern your right to use the Website and your access to and use of the endota Retreat® Platform and/or any products or services acquired in relation to the endota Retreat® Platform and/or any links provided on the Website to other websites.

3.2. In downloading any content from the Website to your computer, to another device or in any other way, you acknowledge that you do not receive any ownership rights to such content and by downloading any content you agree not to use the content for any unlawful purpose and you agree that your use of the Website is only for your personal use and not for any commercial or other use contrary to these Terms and Conditions and our legal rights in respect of the Website and/or the Platform.

3.3. You agree that in downloading any service or product from the Website, you will not rent, lease or lend it to a third party nor decompile, reverse engineer, modify or derive content from the Website and/or make it available over a network where it could be used by multiple devices at the same time.

3.4. You agree that your use of the Website will not violate any laws without limitation, including those governing competition, advertising, consumer protection laws, privacy, obscenity, spamming, stalking, intellectual property rights and/or defamation in Australia and when accessed in another jurisdiction the laws of that jurisdiction and Australian law, so far as the laws are not inconsistent, in which case you agree to be bound by the laws in force in Victoria, Australia.

3.5. You agree that in using the Website, you will not post threatening, harassing, defamatory, obscene, offensive, hate mail or speech or facilitate others to commit such acts in whatever format.

3.6. You agree that we may, and reserve the right to, remove any comments made by you about the Website, any of its content, its individual representatives, officers, directors, consultants and/or employees which we believe in our sole discretion to be damaging to us.

3.7. The content on the Website, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like and the trade marks, service marks and logos contained therein, are owned by or licensed to us, subject to copyright and other intellectual property rights under law.

 

4. Promotions

4.1. From time to time, you may be invited to participate in promotions in one of our spas and/or involving or related to endota products. Participation in these promotions may be subject to certain terms and conditions. Terms and conditions applicable to a promotion will prevail over these terms and conditions to the extent of any inconsistency between them.


5. Other Member Benefits

5.1. You may qualify for other promotions, special benefits and exclusive Offers from us and endota Retreat® Platform Affiliates which we may offer or enable as part of the endota Retreat® Platform and membership subscriptions from time to time.

5.2. From time to time, Member Benefits may include endota Retreat® providing you with exclusive personalised Offers based on your individual profile. These Member Benefits will only be available to you.

5.3. We may specify exclusions and conditions (including qualifying spend and offer duration) for particular Member Benefits and we may change these from time to time.

5.4. Other Members Benefits may include:

a) endota Retreat® member-only discounts, newsletters and automatic entry into prize draw competitions which may be run from time to time; and:

b) discounts, exclusive Offers and personalised Offers from members of the endota Retreat® Platform and selected endota Retreat® Platform Affiliates.


6. Privacy Policy (reference)

We will collect, hold, use and disclose your Personal Information in accordance with the Privacy Act 1988, the Australian Privacy Principles and our privacy policy (see /privacy-policy). You should read and understand our privacy policy in full before joining endota Retreat®.


7. By becoming a member of endota Retreat®, you:

a) Consent to receiving Offers and promotional material from third parties (but you may withdraw that consent at any time by writing to customercare@endota.com.au);

b) Request to be contacted in relation to promotions or Offers, using the particular method (e.g. phone, email, SMS or post) specified by you on your membership application form; and

c) Request and consent to us and our associated persons or businesses sending you marketing/promotional material.


8. Changes to Platform, Rules and Offers

8.1. We reserve the right to, at any time and from time to time and without prior notice to you, make changes to the endota Retreat® Platform and the policies and procedures concerning the manner in which Member Benefits can be awarded or redeemed.

8.2. We may also, at any time and from time to time and after 14 days’ notice on the Website make changes to these terms and conditions.


9. Third party Offers

9.1. Your membership in the endota Retreat® Platform may from time to time give you an opportunity to access third party Offers.

9.2. Notwithstanding that you may access third party Offers via your membership of the endota Retreat® Platform, you acknowledge and agree that third party Offers are not offered or provided by us and that, subject to the Australian Consumer Law and to the extent otherwise permitted by law, we have no liability whatsoever to you in relation to third party Offers, even though you may access third party Offers, via the Website and/or via other materials provided to you by us or our franchisees.

9.3. You acknowledge that third party Offers may be subject to terms and conditions of a third party supplier and may be withdrawn or amended at any time.

9.4. Third party Offers may require a payment of a fee to a third party provider of the relevant third party offer and this may require entry of your credit card details for this purpose. If you choose to take up the third party Offer requiring your credit card details, then you acknowledge that you enter your credit card details at your own risk.


10. Opting out

10.1. If at any time you do not wish to receive third party Offers or Member Benefits from us or endota Retreat® Platform Affiliates simply click the unsubscribe link on an email that you have received from us. As part of an endota One account your marketing subscription will be cancelled along with your endota Retreat Guest Access. To unsubscribe from marketing, click the unsubscribe link on any email from endota, or alternatively access your endota One account and click the unsubscribe link.


11. Definitions

11.1. Affiliates means any of our associated entities as that term is defined in the Corporations Act 2001 (Cth);

11.2. Application Form means the form in which a Client’s personal details are recorded in relation to connecting with us and the endota Retreat® Platform;

11.3. Client means a person using our services;

11.4. endota Retreat® Platform means an on demand 24/7 video platform operated and administered by us and providing access to digital content to support your journey to a better wellbeing;

11.5. endota Retreat® Platform Affiliates means selected persons or third-party businesses or companies attached and or established with us and part of the endota Retreat® Platform;

11.6. Licence means the licence granted by us to you governing your use of the Website and the services in accordance with these terms and conditions;

11.7. Member Benefits means special benefits including Offers, content, programs, promotions or discounts that may be available to members of the endota Retreat® Platform from time to time;

11.8. Party refers to a party to these terms and conditions and it includes that party's successors, administrators and assignors and where a party consists of more than person, then these terms and conditions bind them jointly and each of them severally;

11.9. Offer means an exclusive promotion of adjusted value, or otherwise, to select Clients via the endota Retreat® Platform;

11.10. Subscription means the subscription with endota entitling you to use of the Website and the endota Retreat® Platform;

11.11. Terms and Conditions means these terms and conditions as amended from time to time; and

11.12. Website means www.endota.com.au and its content.
